Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Vedavinya Pvt. Ltd. ("Vedavinya", "we", "us") governing your use of Chaiverse, Vedavinya AI and vedavinya.com, chaiverse.in (the "Services"). They are published as the terms, conditions and user agreement under Rule 3(1)(a) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, read with the Information Technology Act, 2000 and the Indian Contract Act, 1872. By creating an account or using the Services you accept these Terms and our Privacy Policy and Community Guidelines.

1. Eligibility & your account

  • You must be 18 years or older, or use the Services under the consent and supervision of a parent/lawful guardian.
  • You are responsible for your device-bound passkey/credentials and for activity on your account. Tell us immediately at [email protected] of any unauthorised use.
  • You agree to provide accurate information and not to impersonate any person or entity.

2. The Services

Chaiverse is a privacy-first social & messaging platform with end-to-end encrypted messaging and a non-manipulative feed. Vedavinya AI is an AI assistant (currently in limited/preview release). Features may change, and we may add, modify or discontinue features with reasonable notice where practicable.

3. Acceptable use & prohibited content

You must not host, display, upload, modify, publish, transmit, store, update or share any information that is prohibited under Rule 3(1)(b) of the IT Rules, 2021, including information that:

  • belongs to another person and to which you have no right;
  • is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, or otherwise unlawful;
  • is harmful to a child;
  • infringes any patent, trademark, copyright or other proprietary rights;
  • violates any law for the time being in force;
  • is deceptive or misleading about its origin, or communicates information that is patently false or misleading but may reasonably be perceived as a fact;
  • impersonates another person;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or incites the commission of any cognisable offence, or prevents investigation, or is insulting to any other nation;
  • contains a software virus or any program designed to disrupt or impair any computer resource;
  • is patently false or untrue, written or published with intent to mislead or harass for financial gain or to injure any person.

Our Community Guidelines form part of these Terms. We may remove content or suspend/terminate accounts that violate these Terms or applicable law.

4. Intermediary status & content

Vedavinya acts as an intermediary under §2(1)(w) of the IT Act and observes due diligence under the IT Rules, 2021, including the "safe harbour" framework of §79. We do not initiate the transmission, select the receiver, or (for end-to-end encrypted messages) have the ability to access message content; we do not generally monitor content. We will disable or remove access to unlawful information upon receipt of actual knowledge through a court order or notification by the appropriate Government/agency, or a valid grievance, within the timelines prescribed by law. You retain ownership of content you create; you grant us a limited, revocable licence to host, store and display it solely to operate the Services.

5. Subscriptions, billing & taxes

  • Chaiverse offers a free tier and a paid plan (indicatively ₹99/month — final pricing TO-BE-CONFIRMED), inclusive/exclusive of GST as stated at checkout; a GST invoice is issued.
  • Paid plans may auto-renew. Recurring payments follow RBI's framework for e-mandates/recurring transactions; you can cancel anytime.
  • Cancellation, refunds and billing are governed by our Subscription, Billing & Refund Policy and the Consumer Protection Act, 2019.

6. Vedavinya AI — additional terms

  • AI output is generated probabilistically, may be inaccurate or incomplete, and is not professional advice. Verify before relying on it.
  • Do not use Vedavinya AI to generate unlawful, harmful, infringing or deceptive content, or to violate §3 above.
  • We do not train Vedavinya AI on your private conversations or private content (see Privacy Policy).

7. Suspension & termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access for breach of these Terms, applicable law, or to protect users and the Services, with notice where practicable. On termination, §§8–11 survive.

8. Disclaimers

The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by Indian law. We do not warrant uninterrupted or error-free operation. Nothing in these Terms excludes liability that cannot be excluded under Indian law (including under the Consumer Protection Act, 2019).

9. Limitation of liability

To the extent permitted by law, Vedavinya is not liable for indirect, incidental, special or consequential losses. Our aggregate liability for any claim is limited to the amount you paid us for the Services in the three (3) months preceding the claim, or ₹1,000, whichever is higher — save where such limitation is not permitted under Indian law.

10. Indemnity

You agree to indemnify Vedavinya against losses arising from your breach of these Terms, your content, or your violation of law or third-party rights, to the extent permitted by Indian law.

11. Governing law, jurisdiction & disputes

These Terms are governed by the laws of India. Subject to the dispute resolution below, the courts at Kolkata, West Bengal have exclusive jurisdiction. Disputes shall first be attempted to be resolved amicably; failing which they may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seat and venue Kolkata, proceedings in English. Nothing prevents either party from seeking urgent interim relief from a competent court.

12. Grievance redressal

For any complaint about content or these Terms, contact the Grievance Officer per our Grievance Redressal Policy — [email protected]. You may also approach the Grievance Appellate Committee under Rule 3A of the IT Rules, 2021.
